1. Acceptance of Terms

By accessing or using MindForge Platform ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you and MindForge Platform. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Platform after modifications constitutes acceptance of the updated Terms.

2. Description of Service

MindForge Platform is an educational gaming platform that provides brain-training mini-games designed to enhance cognitive abilities. Our services include:

  • • Access to various cognitive training games
  • • Progress tracking and scoring system (Funny Score)
  • • Leaderboard rankings and competitive features
  • • Early access program for beta testing

3. Eligibility and Account Registration

To use our Platform, you must:

  • • Be at least 13 years of age (or the age of majority in your jurisdiction)
  • • Have the legal capacity to enter into binding agreements
  • • Provide accurate and complete information when registering
  • • Maintain the security of your account credentials

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. User Conduct and Prohibited Activities

You agree not to:

  • • Use the Platform for any illegal purpose or in violation of any laws
  • • Attempt to hack, manipulate, or exploit the scoring system or games
  • • Use automated systems, bots, or scripts to play games or gain scores
  • • Interfere with or disrupt the Platform's servers or networks
  • • Impersonate any person or entity or misrepresent your affiliation
  • • Harass, abuse, or harm other users
  • • Transmit viruses, malware, or other harmful code
  • • Reverse engineer, decompile, or disassemble any part of the Platform
  • • Collect or harvest information about other users without consent

Violation of these rules may result in immediate termination of your account and legal action.

5. Intellectual Property Rights

All content on the Platform, including but not limited to games, graphics, text, logos, software, and design elements, is the property of MindForge Platform or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not:

  • • Copy, modify, or distribute any content without permission
  • • Use our trademarks or logos without written consent
  • • Create derivative works based on our content

6. User-Generated Content

If you submit content to the Platform (such as feedback, comments, or reviews), you grant us a worldwide, royalty-free, perpetual license to use, modify, and display such content. You represent that you own or have the right to grant such license for any content you submit.

We reserve the right to remove any user-generated content that violates these Terms or is otherwise objectionable.

7. Funny Score and Game Progress

Funny Score (fs) is a virtual scoring system used to track your progress and unlock games. You acknowledge that:

  • • Funny Score has no monetary value and cannot be exchanged for real currency
  • • We may reset, modify, or adjust scores at our discretion
  • • Game progress and scores may be lost due to technical issues or account termination
  • • We are not liable for any loss of progress or scores

8. Service Availability and Modifications

We strive to provide continuous access to the Platform but do not guarantee uninterrupted or error-free service. We may:

  • • Temporarily suspend the Platform for maintenance or updates
  • • Modify, discontinue, or remove features at any time
  • • Change game mechanics, scoring systems, or leaderboard algorithms

We are not liable for any loss or inconvenience resulting from service interruptions or modifications.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY UK LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • • WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • • WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • • WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF GAME RESULTS OR SCORES
  • • WARRANTIES THAT GAMES WILL IMPROVE COGNITIVE ABILITIES OR IQ SCORES

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UK LAW, IQ BOOST PLATFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • • LOSS OF DATA, GAME PROGRESS, OR FUNNY SCORE
  • • LOSS OF PROFITS OR BUSINESS OPPORTUNITIES
  • • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS OR USE
  • • DAMAGES RESULTING FROM SERVICE INTERRUPTIONS OR TECHNICAL FAILURES

Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or £50, whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless MindForge Platform, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • • Your use of the Platform
  • • Your violation of these Terms
  • • Your violation of any rights of third parties

12. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including:

  • • Violation of these Terms
  • • Fraudulent or illegal activity
  • • Extended period of account inactivity

Upon termination, your right to use the Platform will cease immediately, and we may delete your account and associated data.

You may terminate your account at any time by contacting us or using account deletion features (if available).

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MindForge Platform regarding your use of the Platform and supersede all prior agreements and understandings.
